College of Law/ University of Kerbala has discussed the M.A thesis which is entitled “Criminal Protection of Societal Morals: a comparative study”
Being presented by Atheel Ali Kareem, the study aims at highlighting the importance of criminal protection of societal morals and its role in controlling behaviour, and clarifying its philosophical and legal basis and factors influencing it.
The study examines protection frameworks in Iraqi Penal Code No. 111 of 1969 (amended), Anti-Prostitution and Homosexuality Law No. 15 of 2024, and First Amendment to Anti-Prostitution Law No. 8 of 1988. It analyzes relevant texts, identified flaws in them, and compared these texts with other comparative laws.
The study concludes that the proposal to amend text of Article 401 and Article 399 of amended Iraqi Penal Code, in addition to proposal to amend Article 3 and Article 4 of current Iraqi Anti-Prostitution and Homosexuality Law, along with submitting a proposal to Iraqi legislator regarding criminalization of all consensual sexual practices that occur outside framework of marriage, in accordance with principles of Islamic Sharia and provisions of Constitution of Republic of Iraq of 2005.
